Terms of Service

These Terms & Conditions ("Terms") govern your access to and use of the WorkQuora mobile applications and website (together, the "Platform"), operated by [Operator Legal Name — TO BE FILLED] ("WorkQuora", "we", "us"). By registering for or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
These Terms are governed by Indian law, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as applicable to an intermediary marketplace platform.
1. What WorkQuora is
WorkQuora is a marketplace platform that connects individuals or businesses who need local services performed ("clients") with independent freelance workers who offer those services ("workers"). WorkQuora is not an employer, staffing agency, or party to the service performed. See our Disclaimer for the full scope of this limitation, and our Worker Agreement and Client Agreement for the specific terms that apply to each role.
2. Eligibility and registration
You must be at least 18 years old to register. You must provide accurate registration information and keep it up to date. Workers must additionally complete identity verification (KYC) before they can accept jobs, as described in our Privacy Policy and Worker Agreement. As of this version, client-side KYC is not required to post a job or make payment — this Platform requirement may change, and these Terms will be updated if it does.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
3. Account access via Google/Facebook
You may register or log in using your Google or Facebook account. Doing so is subject to that provider's own terms in addition to ours; we only receive the profile information described in our Privacy Policy.
4. The marketplace relationship
A client posts a job describing the work needed and a budget. Workers submit proposals. When a client accepts a proposal, a contract for services is formed directly between the client and the worker — WorkQuora is not a party to that contract. WorkQuora's role is to facilitate discovery, communication, escrow-based payment handling, and dispute support, in exchange for the platform commission described in Section 7.
5. Payments and escrow
When a client funds a job, the payment is held by WorkQuora in escrow via our payment gateway partner, Razorpay, until the job is marked complete by both parties, at which point it is released to the worker (net of commission — see Section 7) or refunded per our Refund Policy and Cancellation Policy if the job is cancelled instead. You authorize WorkQuora and Razorpay to process payments on your behalf as described here.
6. Wallet
Workers accumulate earnings in an in-app wallet, from which they can request withdrawal to a verified bank account. Withdrawal is only available to KYC-verified workers.
7. Commission and fees
WorkQuora charges a platform commission of 10% of the gross job value, plus 18% GST calculated on that commission amount (i.e., approximately 11.8% of the gross job value in total), deducted from the amount released to the worker when a job is marked complete by both parties. This is described in full, with worked examples, in our Refund Policy. This commission structure may be revised by WorkQuora from time to time with notice to users; the rate that applies to a given job is the rate in effect at the time that job is completed.
8. Cancellations and refunds
Cancellation of an in-progress job and any resulting refund or partial payout are governed by our Cancellation Policy and Refund Policy, which form part of these Terms.
9. Conduct
You agree to use the Platform lawfully and in accordance with our Community Guidelines, which form part of these Terms. Prohibited conduct includes, without limitation: harassment or abuse of another user; posting fraudulent job listings or proposals; attempting to circumvent the Platform's payment system to avoid commission (e.g., soliciting off-platform payment for a job discovered through WorkQuora); providing false identity or KYC information; and any attempt to access another user's account or data without authorization.
10. Content you submit
You retain ownership of content you submit (job descriptions, photos, proposals, messages, reviews), but grant WorkQuora a license to store, display, and process it as necessary to operate the Platform, including sharing it with the other party to a job as described in our Privacy Policy. You are solely responsible for content you submit and warrant that it does not infringe any third party's rights or violate any law.
11. Reviews and ratings
Clients and workers may rate and review each other after a job. Reviews must be honest and based on an actual completed interaction on the Platform. We may remove reviews that violate our Community Guidelines.
12. Disputes between users
If a disagreement arises between a client and worker regarding a job, either party may raise a dispute through the Platform. WorkQuora will review the dispute and may, at its discretion, adjust escrow release, apply a partial refund consistent with our Cancellation/Refund Policy, or otherwise mediate — but WorkQuora is not obligated to act as an arbitrator of the underlying service dispute and is not liable for the quality, safety, or legality of services performed between users, as set out in our Disclaimer.
13. Suspension and termination
We may suspend or terminate your account for violation of these Terms, our Community Guidelines, fraudulent activity, repeated cancellations, or at our reasonable discretion to protect the Platform and its users, with notice where practicable. You may close your account at any time as described in our Privacy Policy.
14. Intermediary status
WorkQuora is an intermediary within the meaning of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We do not initiate, select the receiver of, or modify the content transmitted between users, and we observe due diligence as required of an intermediary, including maintaining a Grievance Officer as described in our Grievance Redressal Policy and acting on lawful takedown requests.
15. Limitation of liability
To the maximum extent permitted by law, WorkQuora's aggregate liability arising from your use of the Platform is limited to the platform commission actually earned by WorkQuora on the job giving rise to the claim. WorkQuora is not liable for indirect, incidental, or consequential damages, or for the acts or omissions of another user. See our Disclaimer for the complete scope.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in-app before they take effect. Your continued use of the Platform after a change takes effect constitutes your acceptance of the revised Terms. The Platform records the version of these Terms you last accepted.
17. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to the grievance and dispute-resolution process described in our Grievance Redressal Policy, the courts at [Jurisdiction/City — TO BE FILLED] shall have exclusive jurisdiction over any dispute arising from these Terms.
